Terms and Conditions

Welcome to Loving Loyalty's platform (the "Platform"). Together with our Privacy Policy, these Terms and Conditions (the "Terms") set out the terms by which you (the "Customer" or "You", as the user of the Platform) must use the Platform and when placing an order for one of the products available on the Platform.

By using the Platform you confirm that you have read and understood these Terms and agree to be bound by them in full. If you do not accept these Terms in full, you may not use the Platform.

Who are we?

The Platform is operated by Loving Loyalty ApS (“we”, “us” or “Loving Loyalty”), incorporated and registered in Denmark, with a registered office at Dirch Passers Allé 23, 3. th., 2000 Frederiksberg. Our Company registration number is CVR 41531177.

Loving Loyalty is in the business of seamlessly connecting a variety of partners (the "Partners") to their customers via the Platform, allowing you to order products from your favourite Partner and automatically earn loyalty points which can be redeemed as partial or full payment against future purchases with the same Partner.

Naturally, operating hours will vary depending on the opening hours of the Partner as well as availability of the product or service in question. You simply click on the chosen Partner to view their menu, select your choice, and submit your order.

Orders

Once an order has been submitted, it is registered in the system, and if accepted, you will be able to follow the status of the order in real time . If the order is rejected, you will be notified that your order has been rejected. 

Payment will be made directly to the Partner, and after payment is made, the order status will change to “paid”, at which point you will automatically receive your Loyalty Points. The Platform will notify you of this. If you do not receive your points upon making your payment, you must reach out to the Partner directly as they are required to process your order as being paid, which automatically ensures that loyalty points are added to your account.

At the end of the order journey, you will be able to rate your experience with the Partner on the Platform.  

Price of menu items

All listed prices in the Platform include VAT. Partner menus detail the prices for each product available on the Platform, and the Partners exclusively determine the prices charged for their products. Prices may be subject to change at the will of the Partner, but any change in pricing will be reflected in the Platform.

Loving Loyalty cannot be held responsible in the event of mis-pricing, and such cases must be resolved directly between you and the Partner.  Partners are required to accept orders before they start fulfilling them and/or accepting payment, so in practice incorrect prices should be rare.  

Orders containing alcohol, tobacco and/or allergens

You cannot place or collect orders containing alcohol or tobacco if you are aged 18 or below. By placing an order containing alcohol or tobacco, you confirm that you are at least 18 years old. You must provide proof of age if requested by the Partner who can make the request of anyone looking younger than 25. If proof of age cannot be produced, you cannot collect the order.

Please be aware that Loving Loyalty cannot guarantee that Partners and their products are free of allergens, or that nuts are not used in preparation of the food or beverage in question. Please contact the Partner directly for any specific questions related to allergens and contents of the products.

Complaints

Any complaints or issues with the quality of the product or service should be raised with the Partner and not with Loving Loyalty. We welcome feedback and reviews on the Platform for the Partner to browse. In addition, aggregated scores based on customer reviews will be displayed for other customers to browse. Please also let us know directly if you have an unresolvable issue with one of our Partners.

It is the responsibility of the Partner to update the Platform, where products are unavailable (due to stock shortages or other reasons). If an order is placed for a product that is not available, the the Partner must contact you as soon as they realize and attempt to resolve the issue either by offering an alternative, or by rejecting the order. This communication between the Partner and you will happen outside the Platform.

Cancellation of orders

It is not possible for you to cancel a submitted order. The Partner may reject an order after it has been received, for instance due to lack of stock, or during times of extreme busyness, etc. You will be notified in the Platform if your order is rejected by the Partner. The contact details for Partners are available on the Platform so that you may contact the Partner. 

If you submit a fraudulent order, meaning you submit an order without having the intention to pay for it, your account will be blocked, and, if considered necessary, reported to the proper law enforcement authorities. 

After submitting an order, the Partner controls the status of the order, and Loving Loyalty cannot intervene on behalf of you, nor request the Partner for updates on your order status. 

Liability

Events outside anyone's control happen, such as lack of availability of Internet connectivity, which in turn can impact processing of your order. Loving Loyalty is in no way liable for any delay or other issue relating to your order arising from an event outside our control. 

Loving Loyalty makes no representation or warranty regarding to quality of the products purchased through the Platform. Neither Loving Loyalty nor any of our Partners shall be liable to you for any direct, indirect, or consequential loss or damages arising in contract, tort (including negligence) or otherwise arising from your use of the Platform.

Any liability by either Loving Loyalty or its Partners shall be limited to the purchase price of the order placed. This, of course, does not include liability for illegal behavior such as fraud or death and personal injury caused by negligence.

Misuse of your account

Loving Loyalty and our Partners can in no way be held accountable, either directly or indirectly, for misuse of your account by unauthorized individuals, resulting for instance of access to your account (example theft of your mobile device or loss of your mobile phone number). It is your responsibility to make precautions to avoid sharing your account information with others.

Direct Marketing

Loving Loyalty believes that you should be given ongoing choice and control over how we use your data. You may decide what kind of communication you wish to receive by going to your profile and tapping Notifications. The default is that all communication will be enabled. We may also use your information to let you know about and promote other products and services made available by our Partners that you have not tried yet, but that we believe could be of interest to you. We may contact you by email or directly through the Platform. Loving Loyalty may also call you directly on the mobile phone number or email addrress you provided during registration to obtain feedback about the Platform and suggestions for improvement.

When placing your first order through Platform, you may use a referral code from a friend or a family member, which entitles both you and the person who referred you to receive 100 Loyalty Points with the vendor you place your first order with. You may also refer other people to use the Platform, in which case you will receive 100 Loyalty Points when the person you referred places their first order using the Platform.

You may refer as many people as you wish, and will be awarded 100 Loyalty Points for each referral that results in an order being placed through the Platform.

Waiver

Loving Loyalty and our Partners shall not be responsible to anyone for any non-performance of their obligations under these Terms which is the result of an event outside their control, including but not limited to acts of God, fire, war, incoming regulation or legislation, etc.

Entire Agreement and Severability

These Terms amount to the whole agreement between you and Loving Loyalty and our Partners and supersedes all other prior agreements and understandings between the parties.

If any provision of these Terms is judged to be illegal or unenforceable, the remainder of the Terms will continue in full effect without prejudice.

Changes to these Terms

Loving Loyalty reserves the right to revise, or otherwise make changes, to these Terms. You may periodically check the Terms here: https://lovingloyalty.com/page/terms for any updates or amendments.

Governing Law

These Terms shall be governed by the laws and regulations of Denmark. Any claims or dispute arising in connection with the Platform or these Terms shall be subject to the jurisdiction of the courts and arbitration authorities of Denmark.
